These Terms of Service ("Terms") govern your use of the AllergySnap™ mobile application ("App") operated by NOVARKI LLC ("we," "us," or "our"). By using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using AllergySnap™, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

AllergySnap™ provides food allergen detection services through:

• Barcode scanning to retrieve product information
• QR code scanning for ingredient data
• AI-powered photo analysis of ingredient labels
• Color-coded safety indicators based on your allergen profile

3. User Responsibilities

You agree to:

• Provide accurate allergen information for your profile
• Use the App responsibly and for lawful purposes only
• Not rely solely on the App for critical health decisions
• Verify ingredient information, especially for severe allergies
• Keep the App updated to ensure accuracy

4. Limitations of Service

You understand and acknowledge that:

• The App is an aid, not a replacement for careful label reading
• Product formulations may change without notice
• Database information may occasionally be incomplete or outdated
• AI analysis, while advanced, may have limitations
• Cross-contamination risks cannot always be detected

5. No Medical Advice

The App does not provide medical advice. Information provided by AllergySnap is for informational purposes only. For medical advice regarding food allergies, including diagnosis, treatment, or management, consult qualified healthcare professionals.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy or completeness of allergen detection
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVARKI LLC SHALL NOT BE LIABLE FOR:

• Any allergic reactions or health issues
• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or use
• Damages exceeding the amount paid for the App

8. Indemnification

You agree to indemnify and hold harmless NOVARKI LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

9. Intellectual Property

All content in the App, including but not limited to text, graphics, logos, and software, is the property of NOVARKI LLC or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Updates and Modifications

We may:

• Update the App to add features or fix issues
• Modify these Terms with notice via the App or website
• Discontinue features or the entire service with reasonable notice

12. Subscription and Payments

If you purchase a premium subscription:

• Payments are processed through Apple App Store
• Subscriptions auto-renew unless cancelled
• Refunds are subject to Apple's policies
• Prices may change with notice

13. User Conduct

You agree not to:

• Reverse engineer or attempt to extract source code
• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the App's operation
• Attempt to gain unauthorized access to our systems

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in Austin, Texas, in accordance with the rules of the American Arbitration Association.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NOVARKI LLC regarding the use of AllergySnap.
